Section 1 Party Wall Notice – Line of Junction | Divaar
What is a Section 1 Notice?
A Section 1 Notice (Line of Junction Notice) is required where a Building Owner proposes to construct a new wall at or astride the boundary line between two properties, in accordance with the Party Wall etc. Act 1996.
This type of notice applies only to new walls at the boundary and does not relate to works to existing party walls.
When is a Section 1 Notice required?
A Section 1 Notice is required where a Building Owner intends to:

Build a new wall up to the boundary line, or
-
Build a new wall astride the boundary line (subject to the Adjoining Owner’s consent)
The notice must be served before works commence, even if the wall is to be built entirely on the Building Owner’s land.
Typical examples of Section 1 works
Common projects that may require a Section 1 Notice include:

Rear or side extensions built up to the boundary

New flank walls at the property boundary

Garden walls or boundary walls forming part of a structure

Replacement boundary walls where a new wall is proposed
Notice period

The minimum notice period for a Section 1 Notice is 1 month before the proposed works commence.
What happens after the Notice is served?
Once a Section 1 Notice is served, the Adjoining Owner may:

Consent to the proposed works, or
-
Dissent, in which case a dispute is deemed to have arisen and surveyors must be appointed under the Act.
If the Adjoining Owner consents, works may proceed after the notice period has expired.
Important clarification
Where a wall is proposed astride the boundary, the Adjoining Owner’s express consent is required.
If consent is not given, the wall must be constructed entirely on the Building Owner’s land, up to the boundary line.
