What is a Schedule of Condition?

A Schedule of Condition is a detailed written and photographic record of the condition of an Adjoining Owner’s property prior to notifiable works commencing under the Party Wall etc. Act 1996.

It provides an objective baseline against which the condition of the property can be compared should damage be alleged during or after the works.
 

When is a Schedule of Condition required?

A Schedule of Condition is commonly prepared where:

  • A Party Wall Notice has been dissented to

  • Surveyors have been appointed under the Act

  • Works have the potential to affect an adjoining property

Although not expressly required in every case, it is widely regarded as best practice and is almost always included within a Party Wall Award.
 

What does a Schedule of Condition include?

A Schedule of Condition typically includes:

  • Written descriptions of relevant internal and external areas

  • High-quality photographic records

  • Notes identifying existing cracks, defects, finishes, and general condition

  • Clear referencing to rooms, elevations, and locations

The document is agreed or settled by the appointed surveyor(s) and appended to the Party Wall Award where applicable.
 

Why is a Schedule of Condition important?

A properly prepared Schedule of Condition:

  • Protects the Adjoining Owner by recording existing condition

  • Protects the Building Owner against unfounded damage claims

  • Reduces the scope for dispute

  • Provides clarity should remedial works or compensation be required
     

How the Schedule of Condition is used

If damage is alleged during or following the works, the Schedule of Condition is used to:

  • Compare pre- and post-works condition

  • Identify whether damage is new or pre-existing

  • Assist surveyors in determining making good or compensation
